These Terms of Service govern your use of Calovex, an AI-powered fitness, nutrition, recipe, and workout tracking app operated by Calovex Software, based in New Brunswick, Canada. By accessing or using Calovex, you agree to these Terms. If you do not agree, do not use the app.

About Calovex

Calovex provides tools for tracking meals, calories, macros, recipes, workouts, goals, and progress, including AI-assisted estimates based on photos, text, recipes, and user inputs.

Calovex is provided for general wellness and informational purposes only. It is NOT medical advice, nutritional advice, diagnosis, treatment, or a medical device.

Health and medical disclaimer.

You should consult a qualified healthcare professional before making major changes to your diet, exercise program, weight-loss plan, or health routine, especially if you are:

  • Pregnant or breastfeeding
  • Living with diabetes
  • Living with heart disease
  • Recovering from or currently experiencing an eating disorder
  • Living with a history of disordered eating or obsessive tracking behaviours
  • Under medical care for any other condition

AI estimates

AI-generated calorie, macro, recipe, and workout results may be incomplete, inaccurate, or inappropriate for your individual needs. You are responsible for reviewing, editing, and deciding whether to rely on the information provided by the app.

Account

You are responsible for maintaining the confidentiality of your account and for all activity under your account. You agree not to:

Your content

You retain ownership of the meals, photos, recipes, workout logs, notes, and other content you submit to Calovex.

You grant Calovex Software a limited, non-exclusive, worldwide license to host, store, process, analyze, display, and use that content only as necessary to operate the app, provide requested features, maintain security, troubleshoot issues, provide support, and improve non-personal product functionality. We do not sell your user content.

Subscriptions

Some features require a paid subscription (Calovex Pro).

Calovex Pro is an auto-renewable subscription. Payment is charged to your Apple or Google account at purchase. It renews automatically unless you cancel at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends. You can manage or cancel anytime in your App Store or Google Play account settings. If you begin a subscription, any unused portion of a free trial is forfeited.

Subscription pricing, free trials, renewal terms, cancellation rules, and refund handling are shown at purchase and are managed through Apple, Google, or the applicable app store provider. Calovex does not directly control app store billing, refunds, or payment processing.

Refunds

Refunds are handled exclusively by Apple App Store or Google Play, depending on where you purchased your subscription. Calovex Software cannot directly issue refunds for app store purchases. To request a refund:

Promotional codes and complimentary access

Calovex may grant free or discounted access through store-issued offer codes or complimentary grants. This access has no cash value, is non-transferable unless we allow it, and may be limited in time or scope. We may revoke access obtained through error, fraud, or abuse.

Leaderboards, challenges, and rewards

Calovex includes optional leaderboards and challenges. Rankings are based on your logged activity. Any rewards, such as cosmetic badges, titles, frames, or other in-app items, are provided at our discretion, have no cash value, and cannot be exchanged for money. Leaderboards and challenges are not sponsored, endorsed, or run by Apple or Google. We may adjust rankings or withhold rewards where we detect manipulation or abuse.

Service changes and termination

We may modify, suspend, or discontinue any part of the app at any time. We may suspend or terminate accounts that violate these Terms or create risk for Calovex, other users, or the public.

Intellectual property

The app, including its design, software, branding, text, graphics, features, and technology, is owned by Calovex Software or its licensors and is protected by applicable intellectual property laws.

As-is disclaimer

Calovex is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose, availability, reliability, or non-infringement.

Limitation of liability

To the maximum extent permitted by law, Calovex Software will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, data, health outcomes, fitness results, or business opportunities arising from your use of the app.

To the maximum extent permitted by law, Calovex Software's total liability for any claim related to the app will be limited to the amount you paid to Calovex, if any, during the twelve months before the claim arose.

Dispute resolution

Before pursuing formal legal action, you agree to first contact us at support@calovex.app to attempt to resolve any dispute. If we cannot resolve the dispute within 30 days, you may pursue available legal remedies in the courts of New Brunswick, Canada.

Governing law

These Terms are governed by the laws of the Province of New Brunswick and the applicable laws of Canada.

Severability

If any part of these Terms is found unenforceable, the remaining parts will remain in effect.

Changes to terms

We may update these Terms from time to time, and continued use of the app after updates means you accept the revised Terms. Material changes will be communicated through the app or via email when appropriate.
